These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Kriyaetive Verse Private Limited ("Kriyaetive", "we", "us", "our"), a company incorporated under the laws of India, operating the digi.shopping service.
By accessing or using digi.shopping — including the consumer app, business.digi.shopping vendor platform, individual shop storefronts, API services, progressive web app (PWA), or any related services — you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree to these Terms, you must not use our services.

You must meet the following requirements to use digi.shopping:
You must be at least 16 years of age (or 13 in the United States, or the minimum age required in your jurisdiction)
If you are under 18 (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the service
You must have the legal capacity to enter into a binding agreement
You must not be prohibited from using the service under the laws of your jurisdiction
If registering as a vendor, you must be authorised to represent the business you are registering

digi.shopping provides AI-powered product recommendations to help you discover, compare, and purchase products across e-commerce platforms and local retailers. The service includes:
AI-generated product research, recommendations, and comparison features
Direct affiliate links to third-party retailers (Amazon, Flipkart, and others)
The 'Skip These' feature — honest assessments of products our AI recommends against
Newsletter and price alert email services (opt-in only)
digi.shopping Pro — an optional paid subscription with enhanced features
business.digi.shopping — a vendor marketplace connecting local shops with online shoppers
Shop storefronts (shopname.digi.shopping) for registered vendors
The core recommendation service is free and supported by affiliate commissions. We are transparent about this relationship, and our AI recommendations are never influenced by commission rates.

digi.shopping uses artificial intelligence to generate product recommendations, comparisons, and advice. You acknowledge and agree that:
AI-generated content is provided for informational purposes only and does not constitute professional, financial, medical, or legal advice
AI recommendations are based on publicly available data at the time of your search and may not reflect the most current pricing, availability, or product specifications
AI outputs may contain inaccuracies, errors, or omissions — you should always verify product details directly with the retailer before purchasing
The 'Skip These' section contains AI-generated opinions based on analysis of user reviews and product data — these are not statements of fact about any brand
We do not guarantee that our recommendations will meet your specific needs, preferences, or expectations
You are solely responsible for your purchasing decisions

digi.shopping Pro is an optional paid subscription that provides enhanced features including unlimited searches, price alerts, search history, and deeper AI research.
Subscriptions are billed on a recurring monthly or annual basis as selected at the time of purchase
Prices are listed in Indian Rupees (INR) and may vary by region. Currency conversion is handled by your payment provider
Your subscription renews automatically unless cancelled before the end of the current billing period
You may cancel your subscription at any time from the Settings page — cancellation takes effect at the end of the current billing cycle, and you retain access until then
Refunds are available within 7 days of initial purchase or renewal if you have not used Pro features during that period
We reserve the right to modify Pro features, pricing, or availability with at least 30 days' advance notice to subscribers
If you are in the EU/EEA, you have a 14-day statutory right of withdrawal for digital subscriptions, except where services have been fully performed with your prior consent
Free users retain full access to the core recommendation experience. Pro is an enhancement, not a requirement.

As an Amazon Associate, digi.shopping earns from qualifying purchases. We also earn affiliate commissions from other partner retailers including Flipkart, Cuelinks, Impact.com, ShareASale, and others. You acknowledge that:
Product recommendation links contain affiliate tracking parameters
We earn a commission (typically 1–15% of the purchase price) when you buy through our links
This does NOT influence which products our AI recommends or includes in 'Skip These'
We evaluate products based on quality, value for money, customer reviews, and relevance to your query
When you click an affiliate link and visit a retailer, you are subject to that retailer's terms and privacy policy
We have no control over the products, pricing, availability, or fulfilment offered by third-party retailers
This affiliate disclosure complies with FTC guidelines (US), ASA/CAP Code (UK), and applicable advertising standards in all markets we operate in

By using digi.shopping, you agree to:
Use the service for legitimate, lawful shopping research purposes only
Not abuse, spam, overload, or attempt to disrupt the service or its infrastructure
Respect rate limits — excessive automated requests may result in temporary or permanent blocking
Not attempt to access unauthorised areas, reverse-engineer, or circumvent security measures
Not scrape, crawl, or extract data from the service without our prior written consent
Not use the service to generate misleading or fraudulent content
Not impersonate any person or entity, or misrepresent your affiliation with any person or entity
Comply with all applicable laws and regulations of your jurisdiction
Not use the service in any way that infringes the intellectual property rights of others
Violation of these responsibilities may result in temporary suspension, permanent ban, or legal action at our discretion. We will provide notice and an opportunity to respond where practicable.
storefront Vendor Terms (business.digi.shopping) expand_more
If you register as a vendor on business.digi.shopping, the following additional terms apply:
You must provide accurate and up-to-date business information, product listings, and pricing
You are responsible for fulfilling all deals/orders accepted through the platform
Transaction fees (2–3% per completed deal) are charged to the vendor and deducted as per the selected billing plan
You must honour negotiated prices confirmed through QR deal tickets within the specified validity period
You must comply with all applicable consumer protection laws, including display of MRP, return policies, and warranty terms
Kriyaetive reserves the right to suspend or terminate vendor accounts for fraud, misrepresentation, or repeated customer complaints
Product listings that violate applicable laws or our content guidelines will be removed without notice
Vendor data (shop name, location, product listings) will be publicly visible on your storefront page

The digi.shopping brand, logo, tagline ('Find the best products, honestly.'), and visual design
AI-generated recommendations, product analysis, and editorial content
Website source code, layout, and functionality
Smart Lists, comparison pages, and curated content
You may not reproduce, distribute, modify, create derivative works from, publicly display, or sell any content from digi.shopping without our explicit written permission. Limited personal, non-commercial use (such as sharing a product recommendation link) is permitted.
Product names, brand names, and trademarks referenced in our recommendations belong to their respective owners. Our use of these marks is for identification and informational purposes only and does not imply endorsement by or affiliation with those brands.

To the maximum extent permitted by applicable law, digi.shopping and all its services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Accuracy, completeness, or timeliness of AI-generated product information or recommendations
Availability, pricing, quality, or suitability of products recommended by our AI
Uninterrupted, error-free, or secure operation of the service
Accuracy of information provided by third-party retailers, vendors, or data sources
Important: Nothing in these Terms excludes or limits warranties which cannot be excluded or limited under applicable law. In particular, for consumers in the EU/EEA, UK, Australia, and New Zealand, your statutory consumer rights are not affected by these Terms.

To the fullest extent permitted by applicable law, Kriyaetive Verse Private Limited, its directors, employees, and affiliates shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages
Loss of revenue, profits, data, business opportunities, or goodwill
Errors, inaccuracies, or omissions in AI-generated recommendations or product information
Service downtime, interruptions, or unavailability
Actions or omissions of third-party retailers, vendors, or service providers (including product defects, delivery failures, or retailer fraud)
Any transactions or negotiations between you and vendors on the business.digi.shopping platform
Damages arising from your reliance on AI-generated content
Unauthorised access to or alteration of your data, to the extent such access is beyond our reasonable control
Liability Cap: Our maximum aggregate liability to you for any and all claims arising out of or related to these Terms or the service shall not exceed the greater of (a) the total amount you paid to Kriyaetive in the 12 months preceding the claim, or (b) INR 5,000 (approximately USD 60). This cap does not apply to liability for fraud, gross negligence, wilful misconduct, or death/personal injury caused by our negligence.
Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer under the laws of India (Consumer Protection Act, 2019), EU/EEA (Consumer Rights Directive), UK (Consumer Rights Act 2015), Australia (Australian Consumer Law), New Zealand (Consumer Guarantees Act 1993), or any other applicable jurisdiction. Where these Terms conflict with mandatory consumer protection laws, those laws shall prevail.

You agree to indemnify, defend, and hold harmless Kriyaetive Verse Private Limited, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the service (including vendor product listings and reviews). This indemnification obligation does not apply to the extent that the claim arises from our own negligence, wilful misconduct, or breach of these Terms.

We may suspend or terminate your access to digi.shopping in the following circumstances:
Violation of these Terms of Service
Fraudulent, abusive, or illegal activity
Excessive automated requests or scraping that degrades service quality
Non-payment of subscription fees (for Pro subscribers) after a 7-day grace period
At our discretion, for any reason, with 30 days' advance notice (except in cases of fraud or abuse, where immediate suspension may occur)
Upon termination: (a) your right to use the service ceases immediately; (b) any outstanding subscription fees remain payable; (c) provisions that by their nature should survive termination will continue to apply (including Limitation of Liability, Indemnification, and Governing Law). You may request a copy of your personal data before termination in accordance with our Privacy Policy.

We aim to resolve disputes amicably. Before initiating formal proceedings:

We will acknowledge your complaint within 5 business days
We will make reasonable efforts to resolve the dispute within 30 days through good-faith negotiation
If we cannot resolve the dispute informally, either party may pursue formal remedies as described below
EU/EEA Residents: You may also lodge a complaint with the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr or with your local consumer protection authority. Nothing in these Terms limits your right to bring proceedings in the courts of your country of residence for consumer disputes.
India Residents: You may also file a complaint with the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
gavel Governing Law & Jurisdiction expand_more
These Terms are governed by and construed in accordance with the laws of India. Subject to the consumer rights provisions below, any disputes shall be resolved under the exclusive jurisdiction of the courts in India.
Consumer Rights Exception: If you are a consumer in the EU/EEA, UK, Australia, New Zealand, or any jurisdiction with mandatory consumer protection laws, nothing in this clause limits your right to bring proceedings in the courts of your country of residence. Mandatory local consumer protection laws will apply to the extent they provide you with greater protections than these Terms.

Kriyaetive shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, pandemics, wars, government actions, cyberattacks, internet or telecommunications failures, power outages, or third-party service provider outages (including Cloudflare, Google, or payment processors).
update Changes to Terms expand_more
We may update these Terms at any time. When we make material changes:
We will update the 'Last updated' and 'Effective date' at the top of this page
We will notify registered users and Pro subscribers via email at least 30 days before material changes take effect
We will display a prominent notice on the website
Continued use of the service after the effective date constitutes acceptance of the updated Terms
If you do not agree to the updated Terms, you must stop using the service. For Pro subscribers, we will process a pro-rata refund for the remaining subscription period
cut Severability expand_more
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions of these Terms will continue in full force and effect.

Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or of our right to enforce it in the future. Any waiver must be in writing and signed by Kriyaetive to be valid.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kriyaetive Verse Private Limited regarding the use of digi.shopping. These Terms supersede any prior agreements, communications, or understandings, whether written or oral.
